Fast Iron Terms of Service & Buyer Agreement
Effective Date: June 1, 2026
These Terms of Service & Buyer Agreement (“Terms”) govern your access to and use of the Fast Iron marketplace platform (the “Site”) operated by Fast Iron, LLC (“Fast Iron,” “we,” “our,” or “us”).
BY ACCESSING THE SITE OR CLICKING “ACCEPT,” YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE.
1. Platform Overview
Fast Iron operates a marketplace that connects buyers with independent sellers, including equipment dealers. Fast Iron is not the seller of listed items and does not take title to inventory unless explicitly stated.
2. Eligibility
You represent that you:
- Are at least 18 years old
- Have authority to enter into binding agreements
- Will use the Site for lawful commercial purposes
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and current information.
4. Listings and Inventory
All listings (including parts, attachments, and equipment) are provided by third-party sellers. Fast Iron does not guarantee:
- Accuracy of listings
- Availability of inventory
- Condition, quality, or fitness for a particular purpose
You are responsible for verifying all information before purchasing.
5. Transactions
By placing an order or submitting a purchase request:
- You make a binding offer to purchase
- The transaction is between you and the seller
- The seller may accept or reject the transaction
Once accepted, the transaction is binding between you and the seller.
6. Pricing and Payment
Prices are set by sellers and may change prior to acceptance. You agree to:
- Pay all applicable amounts, including taxes and fees
- Provide accurate payment information
7. Shipping, Delivery, and Returns
Shipping and return policies are determined by the seller unless otherwise stated. Fast Iron is not responsible for shipping delays, carrier performance, or damage in transit.
8. No Circumvention
You agree not to bypass the Fast Iron platform to transact directly with sellers introduced through the Site. Any attempt to circumvent the platform may result in account suspension or termination.
9. Acceptable Use
You agree not to:
- Use the Site for unlawful purposes
- Misrepresent your identity or intent
- Interfere with or disrupt the Site
- Attempt to access restricted systems or data
- Use automated tools to scrape or extract data
10. Intellectual Property
The Site, including all content, software, and technology, is owned by Fast Iron or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without permission.
11. Disclaimers
THE SITE AND ALL LISTINGS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FAST IRON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAST IRON SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Loss of profits or business interruption
- Disputes between buyers and sellers
FAST IRON’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU THROUGH THE SITE.
13. Indemnification
You agree to indemnify and hold harmless Fast Iron from any claims, damages, or liabilities arising from your use of the Site or violation of these Terms.
14. Disputes
Any disputes related to transactions are between buyer and seller. Fast Iron may assist but is not obligated to resolve disputes.
15. Termination
Fast Iron may suspend or terminate your access at any time for violation of these Terms or applicable law.
16. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.
17. Changes to Terms
Fast Iron may update these Terms at any time. Continued use of the Site constitutes acceptance of updated Terms.
